Despite the Mu<br>nicipality\u2019s attempts to dispose of the land, Swandev successfully asserted its \u201cclear<br>right of ownership\u201d by producing its registered Deed of Transfer. The court reaffirmed<br>that a public body cannot dispose of another\u2019s property \u201cwithout colour of right\u201d.<br><\/p>\n\n\n\n<p><strong>Possession vs. Title<\/strong><br>While common adages suggest possession is \u201cnine-tenths of the law,\u201d this is a dangerous misconception in Zimbabwean real estate.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Possession (Occupation): Occupation through \u201cCessions\u201d or \u201cOffer Letters\u201d<br>grants administrative rights but does not constitute absolute ownership. It remains<br>vulnerable to re-allocations, double sales, and third-party claims.<\/li>\n\n\n\n<li>Title (The Deed): A registered Title Deed is a real right enforceable against the<br>entire world, including the State. It acts as an \u201cindestructible shield\u201d to vindicate your<br>property.<br>Protecting Your \u201cClean Title\u201d<br>With the Deeds Registry (Amendment) Regulations 2025, Zimbabwe is transi<br>tioning to a more secure, digital system. To ensure your ownership remains secure,<br>maintain a culture of vigilance:<\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Continuous Verification: Do not assume a registry record is static just because<br>you hold a physical deed. Have a registered conveyancer conduct periodic \u201cDeeds Of<br>fice searches\u201d to check for fraudulent caveats, mortgage bonds, or duplicate deeds.<\/li>\n\n\n\n<li>Corporate and Trust Alignment: If a Company or Trust holds the property,<br>ensure Annual Returns are filed and directors\/trustees are correctly authorized. A title<br>is useless if the holding corporate vehicle is \u201chijacked\u201d through fraudulent changes in<br>directorship.<\/li>\n\n\n\n<li>The Purchase Process: Ownership only passes upon Registration of Trans<br>fer at the Deeds Office. Paying the purchase price is a contractual step; you do not<br>own the land until the Registrar signs the new deed.<br>Conclusion: While possession offers a temporary foothold, Title is your only permanent fortress.
